I understand the first shippment of 360's have been overheating or freazing up in the middle of play. I also got wind of a rummor that it was a Microsoft plan and the defects are under waranty. Anybody else get word of this?

I've heard about the overheating problem; anything else, I'm not sure of. For a new system I sure have seen scarce few of them in stores; in fact the only reason I've seen one at all is bc I work at evil inc.

From what I've heard, its a design flaw. They underestimated the power draw of the unit outside a temperature-controlled testing lab set up for optimal play conditions. Most people are just cramming them onto an already-full shelf or setting it on the floor when playing, with a big range of "room temperature" and A/C efficiency/availability ......

Word out there is that a lot of people's 360's were overheating, and a lot of people are wanting to wait until they come out with a "patched" version of the hardware.
I got mine last week and have had no issues show up whatsoever. (And I have played a LOT). I also have mine placed in an open, well ventilated area.

Same thing with me. I got mine on Jan 1st and haven't had problems.
I also have my 360 and 360 power supply in a well ventilated area.
